Terms & Conditions | Roaming Legs Private Limited – Travel Booking Policy

(Applicable for all bookings made via website, agent, or in-person or through other digital methods)

1. Definitions

“Company” / “We” / “Us” / “Our”: Refers to Roaming Legs Private Limited, a company incorporated under the Companies Act, 2013.

“Customer” / “You” / “Traveler”: Refers to the person(s) who have booked or intend to book travel services from the Company.

“Tour”: Means the travel arrangement booked with the Company, including transport, accommodation, and other travel-related services.

“Credit Note”: A non-refundable voucher issued by the Company for future use.

“Force Majeure”: Includes any unforeseen event beyond the control of the Company such as natural disasters, political unrest, pandemics, war, strikes, etc.

2. Scope of Services

Roaming Legs Private Limited provides holiday packages, custom travel plans, hotel bookings, visa assistance, transportation, and other travel-related services, both domestic and international. Services are subject to availability and confirmation by our vendors and third-party service providers.

We do not own or operate airlines, hotels, transport services, or embassies and shall not be held responsible for any actions, omissions, or errors of these third parties.

3. Booking & Payments

Bookings will only be confirmed upon receipt of the initial deposit or full payment, as per the invoice or as communicated by Roaming Legs Private Limited

Final payment timelines will be mentioned in your package confirmation. Failure to comply may result in cancellation and forfeiture of your deposit.

Bookings are non-transferable without prior written consent.

Names provided at booking must match the passport. Roaming Legs Private Limited shall not be liable for any issues arising due to name mismatches or data errors supplied by clients.

Payments can be made via NEFT/RTGS/UPI/Credit/Debit card or other approved digital methods. Cash is not accepted.

4. Travel Documents & Visas

Customers must ensure that passports, visas, insurance, and all mandatory travel documents are valid and available before the trip.

It is your responsibility to reconfirm entry requirements with the respective embassies.

5. Visa Assistance

Roaming Legs Private Limited provides visa facilitation assistance for certain countries; however, the decision to grant or deny a visa solely rests with the consular authorities.

Visa Rejection: No refund will be given by Roaming Legs Private Limited for services rendered if a visa is rejected.

Delays/Resubmissions: The customer bears the responsibility to provide timely and complete documentation.

No Guarantee Clause: Roaming Legs Private Limited does not guarantee visa issuance or processing timeframes.

6. CANCELLATION & REFUND POLICY

A. By the Client:

Cancellations must be submitted in writing via email to info@roaminglegs.com.

Minimum Cancellation charges apply as per the following slab (unless otherwise specified in the tour plan  ) :

B. Non-Refundable Components:

Visa fees, taxes, and processing charges once paid are strictly non-refundable.

Flight tickets (where issued) are subject to airline refund policies and are often non-refundable/non-transferable.

C. Refund Process & Credit Notes:

In the event of cancellations due to reasons beyond Roaming Legs Private Limited control (including visa rejections, airline shutdowns, natural calamities, or public authority orders), Roaming Legs Private Limited will endeavour to recover the paid amount from third-party vendors on your behalf as soon as possible.

However, where a refund is not possible, a credit note of equivalent value (minus non-recoverable charges) will be issued for use on future bookings with Roaming Legs Private Limited.

Credit notes are valid for 06 months from the date of issue. They are not transferable except upon written request and cannot be encashed.

7. Changes & Amendments

Changes to travel plans are subject to availability and may attract additional charges.

The Company reserves the right to modify itineraries due to unforeseen circumstances or operational reasons.

8. Force Majeure

Roaming Legs Private Limited shall not be liable for any delay, change, or cancellation of travel services due to events beyond its control, including but not limited to:

Natural calamities (earthquake, flood, storm)

Epidemics, pandemics, or health emergencies

Strikes, war, riots, government restrictions

Airline, hotel, or embassy shutdowns

In such cases:

Roaming Legs Private Limited will attempt to recover your funds from service providers or negotiate a future credit note where possible.

Cash refunds cannot be guaranteed for amounts already remitted to suppliers or services already utilized .

Travellers are strongly encouraged to purchase travel insurance tailored to their personal needs, including coverage for medical issues and force majeure scenarios.

09. Seatbelt Disclaimer

In many Domestic and international destinations, seatbelts may not be available due to local practices.

Customers are advised to use seatbelts wherever provided.

The Company is not liable for any injury caused due to the absence or non-usage of seatbelts.

10. Shopping & Discretionary Services

Roaming Legs Private Limited does not promote or guarantee any product or outlet visited during the tour.

Shopping, leisure activities, and optional excursions undertaken by customers are done entirely at their own discretion and risk.

11. Medical Fitness & Travel Disclaimer

Customers must ensure they are medically fit to travel.

The Company is not liable for any health-related issues arising prior or during the tour and in case of non-travel , no refund would be issued.

12. Customer Obligations

It is your responsibility to provide accurate information during booking.

You must follow all local laws, customs, and instructions of guides during the trip.

You must possess valid travel documents (passport with minimum six months validity with at least 02 blank pages, visas, vaccination, insurance, etc.).

You are solely responsible for checking airline baggage rules, travel restrictions, and destination guidelines.

Unruly, disrespectful, or disruptive behavior may result in removal from the tour without refund towards the guests or local residents of the country.

You agree to comply with the laws of the destination country.

13. Airlines, Flights & Baggage

Roaming Legs Private Limited does not control airline schedules, and flights may be delayed, rescheduled, or cancelled.

Frequent flyer miles or special requests (seating, meals, baggage) must be made directly with the airline.

Any changes in flight fare, airport taxes, or fuel surcharges are to be borne by the customer, unless already ticketed or demanded by airlines directly.

Air travel is subject to airline terms and international aviation rules.

The Company is not liable for flight delays, rescheduling, baggage loss or damage.

Any grievances related to air travel must be addressed directly with the airline.

14. Brochure, Website & Promotional Content

While we strive for accuracy, itineraries, prices, hotel images, and services mentioned on brochures or websites are indicative and subject to change.

All information provided on our website, brochures, or social media is accurate to the best of our knowledge as of the publication date.

Roaming Legs Private Limited is not liable for any typographical errors, omissions, or updates that occur after the booking.

Any significant change will be communicated prior to travel.

15. Data Privacy & Consent

Roaming Legs Private Limited collects necessary personal data in compliance with the Information Technology Act, 2000.

Data is used only for booking, travel documentation, legal compliance, and marketing (if opted-in).

Data may be shared with third-party providers (hotels, airlines, visa agents) only when required for service execution.

Users may request access, correction, or deletion of their data at any time by emailing info@roaminglegs.com.

16. PHOTOGRAPHY & PROMOTION

By booking with Roaming Legs Private Limited, you grant us the right to use any images or videos taken of you during the trip for promotional purposes (website, social media, advertising), unless explicitly denied in writing prior to departure.

17. Personal Belongings

You are solely responsible for your belongings at all times.

The Company is not liable for loss, theft, or misplacement of items at hotels, during flights, transfers, or at sightseeing locations.

18. Travel Insurance

We strongly recommend purchasing travel insurance covering health, trip cancellation, baggage loss, and other emergencies.

Insurance is not included unless explicitly mentioned in your package.

19. Limitation of Liability

Roaming Legs Private Limited shall not be held liable for loss, injury, death, delay, damage, or inconvenience caused during the trip by any third-party provider.

The Company’s total liability, if proven, shall not exceed the total amount paid by the customer for that specific service.

Roaming Legs Private Limited shall not be liable for any indirect, incidental, or consequential damages.

20. Indemnity

You agree to indemnify and hold harmless Roaming Legs Private Limited, its directors, partners , employees, and affiliates from any claim, liability, loss, or damage arising out of your conduct, breach of terms, or negligence during travel.

21. Director Liability Protection

Directors and officers of Roaming Legs Private Limited shall not be personally liable for any claims, losses, or damages unless arising due to willful misconduct or fraud.

22. Tax Compliance (TCS, GST & RBI/FEMA Regulations)

For all Domestic/Outbound international tour packages offered by Roaming Legs Private Limited:

(i) Goods and Services Tax (GST):
GST will be charged on the total invoice value as per Indian tax laws and applicable rates.
Customers cannot claim Input Tax Credit (ITC) unless they are registered under GST and meet the eligibility under the GST Act. If a customer intends to claim ITC, they must inform Roaming Legs Private Limited in writing at the time of booking and provide necessary documentation to assess and advise on ITC eligibility.

(ii) Tax Collected at Source (TCS):
TCS under Section 206C(1G) of the Income Tax Act, 1961, is applicable on international tour package remittances under the RBI’s Liberalised Remittance Scheme (LRS). TCS will be charged at prevailing rates unless exempted by specific legal provisions.
It is the customer’s responsibility to:

  1. Declare if they fall under the TCS threshold
  2. Provide valid PAN and KYC documents
  3. Notify Roaming Legs in writing before payment if they plan to pay TCS directly to the government. Otherwise, Roaming Legs will raise and collect TCS and remit to the Income Tax Department.

(iii) FEMA & RBI Compliance:
All outbound remittances are subject to FEMA, the RBI’s LRS guidelines, and other relevant regulations. Customers must submit Form A2, KYC, and any required declarations. Roaming Legs shall not be responsible for delays or rejections arising from non-compliance on the customer’s part.

(iv) Disclaimer of Liability:
Roaming Legs Private Limited shall not be held liable for any penalty, delay, or legal action arising from the customer’s misrepresentation or failure to comply with GST, TCS, or RBI/FEMA obligations.

23. Grievances

We aim to resolve concerns within 30 working days in a fair and amicable manner.

24. Governing Law, Jurisdiction & Arbitration

These Terms & Conditions shall be governed by and construed in accordance with the laws of India, including but not limited to:

  • The Indian Contract Act, 1872
  • The Companies Act, 2013
  • The Consumer Protection Act, 2019
  • The Information Technology Act, 2000
  • Any other applicable Indian laws, rules or regulations

All disputes, controversies, or claims arising out of or relating to these Terms & Conditions, including the breach, termination, or validity thereof, or to the services provided by Roaming Legs Private Limited, shall first be attempted to be resolved through amicable negotiations between the parties.

In the event that an amicable settlement is not reached within 30 (thirty) days of the dispute being notified in writing, the matter shall be referred to and finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.

The arbitration shall be conducted as follows:

  • By a sole arbitrator, mutually appointed by both parties
  • The seat and venue of arbitration shall be New Delhi, India
  • The arbitration proceedings shall be conducted in the English language
  • The award of the arbitrator shall be final and binding on both parties

Subject to the above, the courts of competent jurisdiction in Uttar Pradesh, India, shall have exclusive jurisdiction over all matters arising from or related to these Terms & Conditions.

25. Disclaimer

Roaming Legs Private Limited is a booking facilitator and cannot be held responsible for:

Embassy/consulate processing delays

Airline/transport delays or cancellations

Denial of boarding due to passport/visa issues

Any third-party service failures or disputes

By booking with Roaming Legs Private Limited , you confirm that you have read, understood, and agreed to the Terms & Conditions.

These terms are subject to periodic updates, and the latest version will be made available on our website as required.

26. Additional Disclaimers & Risk Acknowledgements

  1. Foreign Exchange Rate Fluctuations:
    Tour prices are based on prevailing foreign exchange rates. Any changes in exchange rates, taxes, airline fuel surcharges, or visa fees between booking and full payment shall be borne by the customer.
  2. FEMA & RBI LRS Compliance Acknowledgement:
    By proceeding with international bookings, customers confirm compliance with FEMA and RBI’s LRS norms. Roaming Legs is not responsible for any consequences due to customer non-compliance.
  3. Double Bookings & Fraudulent Transactions:
    Roaming Legs reserves the right to cancel any booking in case of suspected fraud, duplicate entries, or misrepresentation. The company shall not be liable for overlaps or losses due to parallel bookings made elsewhere or with us by the customer and no refund will be issued.
  4. Force Majeure Liability Limitation:
    No liability shall arise for service disruptions due to events beyond the company’s control, including but not limited to: natural disasters, war, political unrest, epidemics, weather conditions, mechanical failures, or government restrictions. In such cases, the company may offer alternate services or credit notes at its discretion.
  5. Waiver of Liability:
    Customers travel at their own risk. By confirming the booking, they agree not to hold Roaming Legs Private Limited or its directors ,partners or employees or third party suppliers liable for any loss, injury, or damage not directly caused by proven gross negligence or wilful misconduct.

27. Customer Acknowledgement and Acceptance

By proceeding with any booking, payment, or engagement of services with Roaming Legs Private Limited, the customer acknowledges that:

  • They have read, understood, and voluntarily agreed to be bound by these Terms & Conditions;
  • They have been provided the opportunity to seek clarifications or consult independent legal advice if required;
  • They are aware of the cancellation, refund, credit note, liability limitation, seatbelt, travel insurance, and jurisdiction clauses or any other clauses as stated;
  • They accept that these Terms & Conditions, together with the booking details, itinerary, and any written communications issued by Roaming Legs Private Limited, form the entire contract between the customer and the company;
  • They consent to be bound by these Terms & Conditions digitally or physically, regardless of whether a signed agreement is returned, so long as they proceed with a booking or payment.

This acceptance shall apply to all travellers listed in the booking made by the principal customer / dealing with Roaming legs Private Limited , and the customer undertakes to ensure that all co-travellers are also informed of these Terms & Conditions and all have accepted the same as it is NOT the responsibility of Roaming Legs Private Limited to communicate to all .
